What happened
Ken Saro-Wiwa and eight others, known as the Ogoni Nine, were executed in Nigeria on 10 November 1995 following the decision of a military tribunal. They had opposed Shell's operations in Ogoniland. Shell halted production in Ogoniland in 1993.
Litigation followed. Wiwa v Shell was settled on 8 June 2009 for $15.5 million with no admission of liability; Shell cited a "process of reconciliation". In April 2013 the US Supreme Court ruled in Kiobel that the Alien Tort Statute does not apply extraterritorially. In the Netherlands, The Hague District Court accepted jurisdiction in May 2019 and dismissed all claims in March 2022; the appeal was later withdrawn.
In 2011 the UN Environment Programme (UNEP) assessed Ogoniland. At Nisisioken Ogale, benzene in well water was more than 900 times the World Health Organization guideline and a layer of refined oil about 8 cm thick lay on the groundwater. UNEP estimated that remediation would take 25 to 30 years and asked for $1 billion for the first five years. It found the surface clean-up method used by SPDC, Shell's Nigerian subsidiary, ineffective.
BusinessDay reported in 2018 that the SPDC partnership, in which the state company NNPC holds 55%, would put $900 million of the $1 billion fund in over five years, with a first instalment of $180 million. In December 2024 AP reported, citing leaked UN files, that a January 2022 UN review found 21 of 41 clean-up contractors lacked relevant experience.
Shell completed the sale of SPDC to Renaissance on 13 March 2025. The Nigerian government is discussing restarting production in Ogoniland; this is not confirmed.
